Welcome to the Trolley Clinic website. These Terms and Conditions govern your use of our website and outline the contractual rules and legal agreements regarding our core retail and commercial trolley maintenance, pallet jack servicing, custom fabrications, and general engineering services. By requesting a quotation, booking equipment for repair, or permitting our team to perform work on-site, you agree to be bound by these terms.

1. General Provisions & Legal Framework

  • 1.1 Company Information: This website is owned and operated by Trolley Clinic, a private company based in Johannesburg, Gauteng, South Africa.

  • 1.2 Legal Compliance: These terms are aligned with the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) No. 68 of 2008 and the Protection of Personal Information Act (POPIA) No. 4 of 2013.

2. Quotations, Customer Data, and Pricing

  • 2.1 Accuracy of Information: The client guarantees that all business records, fleet specifications, contact details, and operational information provided to Trolley Clinic are correct, accurate, and true.

  • 2.2 Validity of Quotes: Due to fluctuations in material sourcing costs (including steel, tubing, and imported hydraulic components), all written quotes provided by Trolley Clinic are valid for a strict period of 14 days from the date of issue.

  • 2.3 Pricing Adjustments: All engineering descriptions, specifications, and prices are subject to change without prior notice before an order is officially accepted. Prices are quoted in South African Rand (ZAR).

3. Custom Fabrication & General Engineering Services

  • 3.1 Scope of Work: Custom projects are handled under our specialized general engineering services. This includes custom retail/commercial trolley builds and related structural steel fabrications.

  • 3.2 Design Sign-off: The client is required to sign off on final dimensions, technical layouts, or CAD configurations before manufacturing commences. Trolley Clinic accepts no liability for layout errors resulting from client-approved designs.

  • 3.3 Production Deposits: A deposit of between 50% and 80% (dependent on the scale and material requirements of the specific project) is required to secure raw materials and initiate production runs. This deposit is strictly non-refundable once steel processing, manufacturing, or custom cutting has begun.

  • 3.4 Technical Tolerances: Standard commercial structural engineering tolerances apply to all custom trolley builds and engineering fabrications.

4. On-Site Service & Field Work Requirements

  • 4.1 Safe Working Environment: Where Trolley Clinic technicians perform on-site repairs, asset servicing, or fleet inspections, the client must ensure the designated workspace is entirely clear, physically safe, and free from active operational hazards. This includes protection against falling overhead objects (such as unstable pallets or warehouse bricks) and moving vehicles/forklifts.

  • 4.2 Utility & Space Allocation: The client must provide clear access to essential utilities, including stable electrical power and fresh, clean water, alongside designated, secure parking space for the Trolley Clinic service vehicle.

  • 4.3 Health and Ventilation: On-site working areas must be well-ventilated and completely free from hazardous environmental impacts. All site conditions provided by the client must fully comply with the Occupational Health and Safety Act (OHSA) No. 85 of 1993. Trolley Clinic reserves the right to immediately suspend on-site operations if a workspace is deemed unsafe by our team.

5. Pallet Jack & Equipment Repair Services

  • 5.1 Evaluation Fees: Equipment brought into our workshop or assessed on-site may be subject to a strip-and-quote evaluation fee if the client chooses not to proceed with the recommended mechanical repairs.

  • 5.2 Loan Equipment: Where available and arranged, Trolley Clinic may provide temporary loan units to minimize warehouse operational downtime. The client accepts full operational and financial liability for any damage, theft, loss, or negligent misuse of Trolley Clinic loan units while in their possession.

  • 5.3 Uncollected Assets: Repairs must be paid for in full prior to collection or delivery. Any client equipment left uncollected at our workshop located at Unit 3 – 170 Bernie Street, Kya Sands, Randburg for more than 90 days following completion notification may be sold via public or private sale to defray storage and accrued repair expenses.

6. Warranties and Limitation of Liability

  • 6.1 Limited Service Warranty: We provide a dedicated warranty on new hydraulic seals and structural weld repairs executed by our team, subject to normal, reasonable operational usage.

  • 6.2 Warranty Exclusions & Void Conditions: Warranties strictly do not apply, and will be voided, if Trolley Clinic identifies clear physical evidence of:

    • Operational overloading beyond the rated capacity of the trolley or pallet jack.

    • Debris choking (e.g., plastic shrink-wrap, packaging straps, or warehouse wire tightly wound into the wheel axles).

    • Operation in highly wet, moist, or chemically corrosive environments resulting in premature structural rust or component degradation.

    • Severe impact damage, structural scratching, or unauthorized third-party modifications.

  • 6.3 Liability Limit: To the maximum extent permitted by South African law, Trolley Clinic shall not be held liable for any direct, indirect, incidental, or consequential operational losses, warehouse delays, or injuries resulting from the use, failure, or maintenance delays of serviced material handling equipment.

7. Governing Law

These terms and conditions are governed exclusively by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of services rendered or transactions made shall be subject to the exclusive jurisdiction of the South African courts.
